Lincoln suspended Habeas Corpus during the Civil War and he didn't even have Cuba to deposit people he didn't like.
You do realize that he did this validly under Article 1, Section 9 of the Constitution right?

Well President Lincoln HAD to do something.... the Civil War was raging.

President Obama and President Bush can't do what Lincoln did because there is no rebelion in these United States. So our fearless leaders are FORCED (Constitutionally) to keep these motherfuckers in Gitmo where they have NO Constitutional protections.

Geography is saving us. The United States government has NO Jurisdiction in Cuba, none what-so-ever. Unlike Guam and Puerto Rico, Cuba is not a possession/territory of the United States of America. We have them there SPECIFCALLY because of the Constitution. Bring them here, and (well) they get a trial.

I don't want them getting a trial. Afghanistan and Iraq have already told us that no matter what, they don't want these people to come back to them. We are stuck with them.

Give those fuckers a military trial. If we can convict them, them convict them and lock 'em up and throw away the key. If we can't then set them free. Those guys have served longer terms than a lot of the Nazi's that slaughtered people in concentrations camps. We are America dammit. If we are not going to even come close to abiding by our own rules then we are no better then them.
