Yeah, we covered that in my Legal Environments class in school. Most people will see that and then six months later start talking again about frivolous lawsuits.

The coffee suit was bad. Coffee, by most all experts, is recommended to be brewed to 195-205F.
The brewing temperature of the water used is very important. It should be between 195 F (91 C) and 205 F (96 C). The closer to 205 F (96 C) the better. Boiling water (212 F - 100 C) should never be used, as it will burn the coffee. Water that is less than 195 F (91 C) will not extract proper...

She held the cup between her legs and spilled it through clumsiness. This coffee was picked up through the drive-thru, and most feel that she balanced the cup between her nylon sweatpants covered bony, elderly knees as her son-in-law pulled in to a space. She admits the coffee was spilled through her own clumsiness.

So, coffee being brewed to its proper temp. Check.

Person carelessly handling a hot beverage. Check.

Person gets burned and blames the business who did nothing wrong. Check.

McDonald's sells millions of cups a day. The fact that they had 700 morons who complained about hot coffee over a four-year period is not impressive. So, when I get coffee now about half the time I get a tepid cup of brown water.

yea I don't know

I really can't decide on this one

I was more interested in how this has been distorted as the poster child for frivolous lawsuits over the years.

fwiw, I oppose tort reform.

Brewing temp is not the same as serving temp. You dont drink 200 degree coffee

True. It's not the same. But I want my coffee as close to brewing temp as possible. Poured as close to the brew finish as possible.

I do NOT want coffee brewed to 205 and allowed to cool down to a "safe" 140 before it's sold to me. Few coffee drinkers do. And further, a busy restaurant being required to brew coffee to the proper temp but cool it for a half an hour or more is silly and impractical. So, what they do instead is turn the brew temp down which ruins it.

Good lord, you are a Wayne County gomer, going to Second Empire and ordering deer meat.

That's no call for sass. Wake County is just a generation or so from being Wayne County. They're just paying tribute to their roots, much like the Allman Bros. paid tribute to Jerry when they played at Walnut Creek that time...
