LEXINGTON, Ky. – UK men’s basketball senior forward Derek Willis was found passed out in the street outside a vehicle when he was arrested in Boone County Saturday.

The video is on the KSR website... UK has a zero tolerance policy for DUI's.. Doubt this kid will ever play another game for UK. Could have really used him this season.

If he was not operating, or in the operator's seat during the stop, is it a DUI? Or is it public intoxication?

I'm pretty sure they dropped the zero tolerance policy after Jules Camara
plus Willis is an indian. You know they get a pass on alcohol tolerance

In NC, you have to prove operation, and I am sure it is similar in other palces. I have successfully defended clients with BAC's as high as .24 and .25 because the driver was not seen operating the vehicle and outside of the vehicle when LEO's arrived. One time, my client had puked all over the place, and he and his brother were passed out on the sidewalk. At 2pm on a Sunday, they had collided with a light pole on George St. During the trial, it was revealed that the brothers had consumed a fifth of Seagram's Gin and a case of Budweiser up to that point. The trial was hilarious.

You would have a witness to the operation of the vehicle then. However, if you drive off and then have a few/several drinks before officers track you down, you're better off. You get a "leaving the scene of an accident" charge, but you have created plenty of room for reasonable doubt as to whether or not you were intoxicated at the time of the collision. They will know you're impaired when they get you, but they can't prove if you were impaired at the time of the collision.
