from TN Code 39-17-1351

Tic, you are just flat wrong, period. That is the TAC they were WRONGLY trying to use it to keep guns out of vehicles. Your wrong interpretation of that TAC is EXACTLY why they passed the "guns in trunks" bill, to keep overzealous people from trying to extend it to the private property of the car owner.bluetick wrote:from TN Code 39-17-1351

Again you just don't seem to get the point. They can make all the company policies they want but it doesn't matter. They have no power, NONE over your private property becuase the guns in trunks bill made it clear that IN THE CAR IS THE PRIVATE PROPERTY OF THE CAR OWNER, NOT THE LAND OWNER. That is what you can't get through your head. No I can't get my gun out on the property, but I CAN leave it in the car REGARDLESS OF THE SIGN because when it is in the car it is IN MY PRIVATE PROPERTY, NOT ON THE LANDOWNERS. Yes the CAR is ON the landowners property, but inside that car is the CAR OWNERS PROPERTY REGARDLESS OF WHERE IT IS SITTING. Huge distinction that apparently people like you just couldn't fathom and they had to pass the bill to make it CRYSTAL CLEAR.
Befor businesses would try to use that code and penalty of law, now they can't. They can call the cops all they want and say "I think so and so has a gun in the car and I have signs posted" the police will say tough even if they do it's not against the law guns in trunks makes it clear the landowners property does not extend into the car and they are not in violation of TAC 39-17-1359 to keep their gun in their private property (the car).
So there is no way they can control what is in your car, your private property because they have no law to get the car searched, nada, none, zilch. That flawed interpretation of the TAC above is forever gone and they cleared it up that no it does NOT apply to the private vehicle. That's why even though Mountain States Health Alliance has an official policy of NO TOBACCO USE ON THEIR PROPERTY OR IN THEIR BUILDINGS the legal eagles made it clear they can't stop them from smoking inside the car because MSHA doesn't own the car, the car owner does regardless of where it is sitting. Heck even when I took my CC course which was before this bill the official ruling was that you could have your weapon in the vehicle even dropping kids off at school and no guns are allowed on their "property" either but the reason was that as long as it was in the car it wasn't on their property, it was on the car owners property, his vehicle.
In an example you may understand they can have a company policy that prohibits you from having a TV in your home. That means about as much as the company policy of no guns now. Means squat because they have no law to hold over anyones head.
Sure if they find out they can fire you for it, but that's it, nothing else. Of course as Ron Ramsey explained Tennessee is an at will state all they have to say for anything is "your services are no longer needed". Doesn't matter what, why when or where so again the company policy means nothing. Ramsey did a good job explaining why people that thought it didn't do anything were just flat out wrong (hint that would be you). You may want to search that and read up on it.

Re: Puterbac News Network and Political Discussion Thread
Actually his point was it doesn't matter about anything else if the employer is wise in their choice of words and just said "your services are no longer needed". His contention is the employer would lose in court if he/she admitted to firing someone for having a gun in their car since it is a lawful act and then he said of course a smart HR person would just say "your services are no longer needed" and not give that reason to stay out of trouble since Tennessee is an at will state. He said something about case law being in favor of the employee if they are fired for what is a lawful act (like owning a TV or having a gun in your trunk) heh.10ac wrote:Of course as Ron Ramsey explained Tennessee is an at will state all they have to say for anything is "your services are no longer needed".

I don't happen to agree with that because I would think company policy would dictate what they could and couldn't fire for and as long as they followed their policy they could fire you for anything they want exept one of the "protected" status thingys.

TICK read the guns in trunks bill, it specifically says the TAC does NOT apply so long as the gun is in the PRIVATE OWNED VEHICLE OF THE GUN OWNER.
Now that brings questions as to what happens if it were a borrowed vehicle, but still it is clear that the TAC doesn't apply to vehicles because the vehicle is PRIVATE PROPERTY. People that can't understand that in the vehicle is NOT on the property of the landowner but the property of the vehicle owner is why the guns in trunks bill had to be written. You just don't get it. The car is not under control by the landowner. You can't have it both ways. Either it is private property and the landowner has no control over it or the car belongs to the landowner when it's on his land but then the landowner would be LIABLE for everything in the car. No way that stands and as a matter of fact it has never stood when challenged vehicles have always been private property so I doubt it would hold up whether the vehicle was borrowed or not unless it was borrowed from someone that didn't want a gun in their vehicle.
That distinction is exactly why you are still allowed to go pick your kids up at school while armed so long as you didn't get out of the vehicle, because even though weapons are not allowed on school property if you stay in the car you are in YOUR property NOT school property. He pointed out though that if you did get out you must leave your weapon in the vehicle because when you step out of your vehicle you are on school property and in violation of the law. Of course the instructor/cop who taught the handgun permit course and illustrated that distinction could be wrong, but I doubt it.
Ron Ramsey, who wrote the guns in trunks bill could be wrong about what he wrote, but I doubt it.
Either way I'm done with it LOL.

For 3 days you've referred to something called "TAC." It's TCA, numbnuts. Tennessee Code Annotated. No thanks necessary..Big Orange Junky wrote:bluetick wrote:BOJ, I've posted the law as it stands.
