The bill passed by 154-2 in the Massachusetts House and unanimously, 37-0, in the Massachusetts Senate -- including the vote of Sen. Scott Brown, who won Teddy Kennedy's seat in the U.S. Senate in January 2010 by pledging to be the "41st vote against Obamacare."

Or as Ann Coulter said in her piece "Three Cheers for RomneyCare!" back in February, the only difference between romneycare and obamacare is one is constitutional and the other is not. Well - rest easy Sweet Ann...they're both good to go now. bwahaha

The most fascinating part of the majority opinion was the fact that they said Congress can expand Medicaid, but it can't strip states of all their Medicaid funds if they fail to participate in that expansion...yet it is ok to mandate individuals to procure coverage or pay a fine. Huh?

Yep he did exactly that, but I disagree as the majority rewrote the law.

The law as written CLEARLY referred to the mandate as buy this or pay a PENALTY. The congress was very clear about this distinction. If they wanted to call it a tax they could have done just as they did with other provisions in the law. Instead the SPECIFICALLY called it a penalty and the left and the president clearly said this is not a tax it is a penalty.

For they KNEW that if they called it a tax in the law and when pushing it in front of the public that it stood ZERO chance of passing. So instead they called it a penalty.

It appears from the dissent that they are saying if they used the word tax instead of penalty that it would have been constitutional (i disagree, but I'm not all the wya through thte dissent yet) , but they didn't do that. Congress explicitly used penalty for a reason. What should have been done is the law struck down and SCOTUS saying change this to the word tax everywhere and pass it again and then we'll talk again.

Instead the majority bypassed congress and change the words on their own ignoring that congress was specific in its wording and intent.

Tick still thinks that Obamacare was ruled consititutional. Dumbass. It was ruled as a tax thus is governed by Congress' taxing authority. Basically he weaseled out...but he did NOT rule it constitutional...

I would think that you would be far more outraged by the fact that the government forces you to pay income tax every year (and at a massively higher rate) than you would be at this comparatively trifling little scheme. At least the fucking commerce clause has some restraint to it.

Although I am amazed that Ginsburg believes the opposite. Maybe I shouldn't be.

Roberts point was that Wilburn is about as far as the commerce clause has been pushed. That growing food for your own consumption can be regulated as commerce. But he also said the you cannot be FORCED to grow your own food (wheat in this case). You cannot be forced into action by the commerce clause.

She believes otherwise which is amazing to me. This would be a federal govt with unlimited authority.

The individual mandate in the Affordable Care Act aka "Obamacare" was always, clearly constitutional - so much so that conservatives, recall, were not only the ones who came up with the idea in the first place, but generally scoffed at legal challenges when they were first raised.

I dunno wiz - Fox News says it was constitutional...and 60+ news organization headlines proclaim this very minute that the SCOTUS ruled obamacare constitutional.
