I disagree. I used to think a lot like you, but Ive now seen too many wild swings in public opinions and even in terms of experts opinions on this like this change wildly. And maybe some of it is me giving media too much credit and it’s something more like mob hysteria or something.

I suspect RFK Jr is just RFK Jr when working in both areas and yeah he probably has certain specialties and knowledge but people do not generally have some kind of weird polarity in their field where they are both insane and extremely competent at the same time. One of the two views is likely just wrong.

I don't know about his competence at all, I'm talking about his general stances on healthcare writ large, which I think are borderline whacky but in any case just plain wrong (obviously vaccines are the main area where he's far outside the mainstream, but there are other areas as well) and the environment writ large, where I think he has genuine concern and is generally "right" in his thinking about most of the environmental issues (obviously climate change is the biggy here, but my bro says he's done good work in many less high profile areas when it comes to environmental issues). As far as his competence in getting anything done in either of these areas, I have no idea, but I generally tend to support somebody whose general views on any given topic aligns with mine. As I said, I'd be very supportive of his nomination as head of the EPA. Regardless, he's an odd bird for sure..

When I went through the Federal Law Enforcement Training Center in Glenco GA, they spent a lot of time teaching us about Bivens lawsuits. Generally, federal law enforcement officers have qualified immunity against lawsuits. But if a federal law enforcement officer, acting in his official capacity, goes outside the scope of his duties, and violates somebody’s constitutional rights, that person CAN sue you under the Bivens law.

So if a corrections officer cuffs up an inmate, and proceeds to beat that inmate up in violation of official policy, that inmate can sue that officer. Not only can that officer be forced to pay out of his own pocket for damages, the federal government will not pay for his legal defense. He’ll have to pay for his own by lawyers.

At least that’s what the instructors taught us. It was a powerful deterrent for federal law enforcement officers not to violate the civil rights of inmates. Under Bivens, that inmate might lawyer up, come back, and take your house, car, life savings, etc. I would be interested in getting Dooksucks legal perspective.

Anyway, this sounds like a great way to go after the present and former leaders of the DOJ and FBI. They’ve been using their law enforcement authority to go outside the scope of their duties to violate citizens civil rights on an industrial scale.

Start with those FISA requests. There are laws that govern those things. By signing them, senior law enforcement officers are stating that those requests are in compliance with those laws. The IG Horowitz report confirmed that 4 of those FISA requests failed to comply with the law. Of course, nothing ever happened that them. Carter Page’s constitutional rights were violated. He should sue every single official (starting with Comey, McCabe and Rosenstein) that signed those fraudulent FISA requests, and take everything they own.

Follow that up with AG Garland, who did not enforce clear federal laws against protests at the homes of ANY federal judge, much less a SCOTUS judge. As a very predictable result, there was an attempted assassination of Justice Kavanaugh. The Kavananaugh’s family’s civil rights were violated. Mrs Kavanaugh should Bivens the crap out of AG Garland for what he did to her and her family, and send him into retirement penniless.

Unfortunately, we don't live in a nation with right or wrong anymore Prof. We live in a "win-lose" nation, an "us or them" nation. What is right and what is wrong, that is predicated entirely on politics, nothing more. These lawsuits would only benefit Carter Page and the Kavanaugh family if (and ONLY if) the judge and/or jury deciding the suit are on their side, politically. That is where we are at.

I have lost faith in what was supposed to be the blindness of our justice system.
