I dont really see how the NCAA can get at most schools that have their ducks in a row. Collectives of donors are forming essentially new businesses to market the athletes. Greg Sankey was quoted today that what they see is not NIL but “just straight payments.” But thats not really true.
Whats happening is that the collectives are just buying out the rights to each player’s name image and likeness up front. Essentially buying from the player the right to market them in the future. Then the collective recoups some of what they pay out from whichever of the players become profitable. They are essentially just marketing agencies. Since the players are selling all their rights up front, yes it looks like "just straight payments" but from the player's perspective they are cashing in the future value of NIL that may never materialize for them in the future. Risk is transferred from the player to the collective which is able to hedge because they are invested in almost every player and inevitably a few will become the stars on the team.

Yes. A&Ms collective is structured as a for profit corporation, but obviously I imagine their goal is break even at best and any extra money going to more players or with donors having to reinvest to cover losses. Some other school’s collectives are structured as charitable organizations, and Im interested to see how that works out.

We have a couple clients that are investing in these. I suspect, in about 3 years, the IRS is going to crack down on those who claim to be trying for profits yet lose money and take deductions. It’s equivalent to a client deducting expenses related to his wife’s horse farm.
