More than 200 musicians filed a brief with the Ninth Circuit Court of Appeals on Tuesday to express concern about the ruling last year in a case brought by the children of Marvin Gaye, who sued for copyright infringement claiming “Blurred Lines” copied Gaye’s hit “Got to Give it Up.”
The musicians said the ruling could have “adverse impact on their own creativity, on the creativity of future artists, and on the music industry in general.”
Gaye’s descendants won a $7.4 million verdict, which a judge reduced to $5.3 million.

I think the issue is where the line is drawn. Throughout history (at least in popular music...and probably before, but I'm not a big consumer of classical), artists have borrowed heavily from others in crafting their songs. Shit, the Eagles "Hotel California" is basically, the Stones' "Angie." For the soul music heads, Meshell N'degeocello's "Outside Your Door" is Brian McKnight's "Anytime."
Those are just ones I can call off the top of my head. I think many of these artists who legitimately compose songs, get their inspiration from other songs (some that they may not realize). If it opens them up to suit, then the amount of lawsuits can become ridiculous. Shit, if "Blurred Lines" wasn't a monster hit of the Summer, the Gaye kids probably would not have even looked to sue.
Maxwell's whole "Urban Hang Suite" album would be a field day for Marvin's kids. That album was basically an alternate take of "I Want You."

[UPDATE] Turns out "Rick K and the Allnighters" are based out of Morgantown, WV and are operated out of a little place right off of Don Knotts Blvd. I didn't know Barney Furley was from WV.
