C. § 158 (1982 ed., Supp. III) directs the Secretary of Transportation to withhold a percentage of otherwise allocable federal highway funds from States "in which the purchase or public possession ... of any alcoholic beverage by a person who is less than twenty-one years of age is lawful." South Dakota, which permits persons 19 years old or older to purchase beer containing up to 3.2% alcohol, sued in Federal District Court for a declaratory judgment that § 158 violates the constitutional limitations on congressional exercise of the spending power under Art. I, § 8, cl. 1, of the Constitution and violates the Twenty-firstAmendment. The District Court rejected the State's claims, and the
Court of Appeals affirmed.
Held: Even if Congress, in view of the Twenty-first Amendment, might lack the power to impose directly a national minimum drinking age (a question not decided here), § 158's indirect encouragement of state action to obtain uniformity in the States' drinking ages is a valid use of the spending power. Pp. 206-212.
Are you completely fucked in the head, lawyer? The Secretary of Transportaion has NO AUTHORITY to set the legal drinking age in the United States of America. None. Zero. That was set in 1984 with a bill created by congress signed into law by Reagan. A quick google search....
The legal age to purchase and consume alcohol in South Dakota is 21 years of age. It is legal to sell alcohol to persons aged 18-20 if they are in the immediate presence of a parent, guardian or spouse who is 21 years of age or older. It is legal to refuse to serve anyone under the age of 21.
That took me two seconds to find. Lawyer. That bolded part, that was just put in for South Dakota because the 1984 federal law signed by Reagan was not perfectly worded and some South Dakota lawyer (probably someone like you) found a way to get around it to allow an 18 year old to buy a beer even if they can't legally drink it. And so now the fed must bribe states because someone in South Dakota, sued? If I had to guess, they wrote the law this way in South Dakota because too many people bitched to their local state reps about how their 18 and 19 year old kids drink with them at the dinner table in their own homes and are not driving. Either way, serve your kids booze in your house, you are breaking federal law.

Then why mention it? You say no shit, so why mention it? I was talking about how federal agencies bribe states NOT to create state law that goes against the policy of a federal agency. If there is a federal law setting minimum age to drink in the USA (and there is), then South Dakota can not go and create their OWN LAW invalidating federal law. Its still against the law in South Dakota for an 18 year old to drink a beer.

Counselor, I'll be kind. I think you and I are on the same side here. I don't like these federal agencies being created for the sole purpose of setting policy (as law) and being forced to give money to the states to bribe them into obey their policies as federal law, when there is no actual law. I would rather our legislators, legislate. If I am not mistaken, you and I agree here. If it is important enough to criminalize, create a fucking law. We don't have to have any federal agency bribe the 50 states into keeping the drinking age at 21. It already is whether they like it or not.

From Politico in 2008

Obama considers stars for Cabinet
By Mike Allen

11/05/2008 12:18 PM EST

President-elect Barack Obama is strongly considering Robert F. Kennedy Jr. to head the Environmental Protection Agency, a Cabinet post, Democratic officials told Politico.

Obama’s transition planners are weighing several other celebrity-level political stars for Cabinet posts, including retired Gen. Colin L. Powell for secretary of defense or education, the officials said.

Kennedy’s cousin, Caroline Kennedy, who helped Obama lead his vice presidential search, is being considered for U.S. ambassador to the United Nations, although some Obama officials doubt she would take the post. Obama is indebted to the Kennedy family for a hearty endorsement at a crucial point in the Democratic primaries.

The selection of Kennedy would be a shrewd early move for the new presidential team. Obama advisers said the nomination would please both Sen. Hillary Rodham Clinton (D-N.Y.) and Sen. Edward M. Kennedy (D-Mass.).

It also would raise the profile of the EPA, which would help endear Obama to liberals who may be disappointed on other issues important to the Democratic left because of budget restrictions.

The EPA enforces clean air and clear water laws. Kennedy, an environmental lawyer and son of the late senator and attorney general Robert F. Kennedy, has long championed a cleaner water supply for New York City.

I wish Trump would put Kennedy as the head of the EPA. He'd be good at that (as Obama recognized). Anything to do with health, not so much...

"Obama’s transition planners are weighing several other celebrity-level political stars for Cabinet posts, including retired Gen. Colin L. Powell for secretary of defense or education, the officials said."

What is the ostensible point here? That Colin Powell, a former head of the Joint Chiefs of Staff and Sec. of State under George Bush is somehow equivalent to the witless D-list political "celebrities" that Trump is tapping for his cabinet? LOL...
