so as an American citizen, if you are identified as an enemy combatant then you rights under the constitution are suspended?

something doesn't seem right there to me.

There is a process through the Department of State by which a person is deprived of their citizenship, and this process is defined by the Immigration and Nationality Act of 1940 (8 USC § 1481), along with specific conditions that are said to denote a person’s willingness to no longer be a citizen of the United States:

-obtaining naturalization in a foreign state

-taking an oath or affirmation of allegiance to a foreign state or a political subdivision therein

-serving in a foreign military actively engaged in hostilities against the United States, or at any time accepting a commission in any foreign military

-obtaining employment in a foreign government, if you’ve obtained nationality of that nation or if the post requires an oath or affirmation of allegiance

-formally renouncing your citizenship before a United States consular officer in a foreign country, in a manner prescribed by the State Department

-committing an act of treason against the United States (as defined by Article III, Section 3 of the Constitution), or attempting to overthrow the United States or take up arms against her

He did come back to the US for school, and he became Iman at a mosque a couple of the 9/11 hijackers attended.

Anyway, he satisfied all of the criteria for his citizenship to be revoked.

He also had Yemeni citizenship and he had a position of leadership within al Qaida. I do not know if he went to a consulate and signed the paper, but it is my understanding that any one of those items will do the trick.

The question is this: while it is obvious he did enough to have citizenship revoked, is there a formal procedure that the US must undertake to effect his citizenship being removed. If so, did we do such?

KABUL, Afghanistan (AP) — NATO captured a senior leader of the al-Qaida- and Taliban-allied Haqqani network active inside Afghanistan, the alliance said Saturday, describing it as a "significant milestone" in disrupting the terror group's operations.

NATO said Haji Mali Khan was seized Tuesday during an operation in eastern Paktia province's Jani Khel district, which borders Pakistan. It was the most significant capture of a Haqqani leader in Afghanistan, and could dent the group's ability to operate along the porous border with Pakistan's lawless tribal areas.

Shortly after NATO's announcement, Taliban spokesman Zabiullah Mujahid denied in a message to Afghan media that Khan had been arrested but provided no evidence that he was free.

NATO described Khan as an uncle of Siraj and Badruddin Haqqani, two of the son's of the network's aging leader Jalaludin Haqqani. However, in a recent report on the Haqqani's by the Institute for the Study of War, Khan appears as a brother in-law to Jalaludin Haqqani..............................................

After reading AA's 1940 Naturalization clauses about revoking citizen, I believe we had the right to kill this guy without due process.

But its because I believe he was not an American citizen.

I would feel better if the president or someone in congress would address it this way, as opposed to trying to convince me that because he was a bad guy worse than John Wayne Gacey, Timothy McVeigh or the Rosenburgs that he deserved to die without trial regardless of his citizenship.
