That's why I was saying yesterday that I don't think the Stanford dude got charged with rape, but sexual assault. For some reason fingering an unconscious girl or putting a foreign object in her isn't considered as egregious as fucking her, which I'm sure this guy would've done if he hadn't been tackled by the Swedes...

A former football player at Vanderbilt University was found guilty Friday night of raping an unconscious student in a dorm room, an attack that was photographed and videotaped by teammates, according to testimony. One of the players sent video of the assault to friends as it was happening.

Four former football players were charged with rape and violations of the student, but only one was on trial this week. The victim in the case, now studying for her doctorate in neuroscience elsewhere, was a senior at Vanderbilt in June 2013. She said at the trial that she had been dating Brandon Vandenburg, another of the four men charged in the case, for two weeks and that the last thing she remembered of that night was him giving her drinks at a bar.
Prosecutors told jurors that the woman was raped in the dorm room in a 32-minute attack that ended with Batey urinating on her and that she was then taken out into a hallway and left there like trash.

I can't say that I've have, but I will readily admit to having sex with more than one woman where both of us couldn't remember the details of the night before.
Now I did know them very well before the act, but I see that as irrelevant.
you guys might not see this as relevant, but lets say that I got hammered drunk one night and for whatever reason I decided to sell my car to a guy for the $20 bill he had in his wallet. He's sober enough to write up a bill of sale which I scribble my name on .
The next morning I wake up and he's driving around with my car and I have no fucking clue as to why - and I accuse him of at first, stealing my car, then when he says I sold him my car, I claim I made a stupid mistake of being drunk but there is no way I'd agree to sell my car for $20.
At the end of the day - does the law say I get my car back?

No, he was rightfully convicted on what he did. And, what he did is not different than what the Vandy football player did. I'm honestly surprised there is any debate over this. I think in most case it likely would not be overturned just based on eCats mental capacity on just the scenario provided, however if eCat is induced to go to blueticks place and bluetick plies him with alcohol specifically to take advantage it would more likely that the contracts in that case would be unenforceable since one party specifically sought to take advantage of the other.
The fact that there is a fairly well established market on cars might make a difference. Selling a car that is very obviously worth thousands for $20 might be evidence that eCat was sufficiently impaired to be unable to make a valid contract and that there wasnt really an equitable exchange.

That specific example was in my business law class in 1985. I am not sure of the $ amount but the issue was the inebriation did not excuse you from a binding contract.
Now my point is that all that separates this in a he said/ he said is that piece of paper. The bill of sale I drunkenly scribbled my name on.
If he was driving my car the next day and someone yelled out.. hey you stole ecats car, the guy may have very well jumped out and ran off because he knew the whole deal looked bad.
Based on the articles provided here..we don't know what transpired at the house from the back rub to the dumpster. What we do know is that no one at the party felt the need to be a good Samaritan and stop her from going out with this kid to wherever they were going.
All we know is that as it relates to the rape is he ran off when confronted and she has no idea what she said or did between the back rub and passing out at the dumpster.

Of course, now it comes out that the Stanford guy wrote a 'plea for mercy' letter to the judge saying that he was a choirboy and not a partier so his '2x' condition made him unaccountable for his actions. Now there's evidence pouring in -social media, text records etc - that appears to show he seriously perjured himself to the court.

Speaking of iphone - in the UT case involving two footballers, text messages by the alleged victim were deemed inadmissible by the current presiding judge, specifically because he's no fan of social media. Accounts have it that her own words suggest she was anticipating a sexual liaison, with references to the player(s) anatomy(ies). Grounds for appeal for the defense, if needed.
